City of Yuma Awarded Nearly $60 Thousand In Water Theft Lawsuit

A jury awarded the City of Yuma three separate verdicts Thursday against Philip K. Clark and PKC Enterprises Incorporated for taking city water without paying for it.  The verdicts together totalled just under 60 thousand dollars-for statutory tampering and theft (known as conversion) of city water.

The water taken was from an unmetered fire suppression line located near Clark's PKC Enterprises Incorporated business known as Diamond Brooks Water.  The tampering and conversion verdicts came against both Clark and PKC Enterprises Incorporated.

The City first noticed unaccounted for water usage in May 2010.  Yuma City Spokesman Dave Nash says the six year time frame to yesterday's verdicts was the result of the federal government stepping in to investigate the case...............

The defendents were accused of theft of city water-which was reprocessed and sold to customers.  Nash says the city lost the water, but city water customers were victims too...............

Yuma City Administrator Greg Wilkinson says an appeal is a possibility in the case.  But he says the City will definitely file motions for triple damages and attorney's fee later this month.
